Medicaid status affects the case in two ways. First, Medicaid may assert a lien on any recovery for medical expenses it paid that are attributable to the negligence. We negotiate and manage these liens as part of the resolution process.
Second, Medicaid status does not reduce the standard of care owed to a resident, nor does it limit the damages available in a lawsuit. A Medicaid resident is entitled to the same quality of care and the same legal remedies as a private-pay resident.
