A colleague recently asked me: “How the [expletive deleted] do you get insurance companies to settle medmal cases a year before trial?”
Recently, we’ve been able to do this in several matters. In a couple of matters, we had not even done any depositions.
The reasons we can do so are multifactorial, to use one of my favorite doctor words.
The biggest factor, however, is credibility.
Partly, that credibility is personal. I have been at this business a long time. Both in my earlier life as a defense lawyer and more recently representing patients and families, I have handled a lot of cases. I have tried a lot of cases all over Virginia. The insurance companies and defense lawyers know me – and they know I know what I am doing.
But my reputation is likely the lesser part of the equation.
