Our firm recently secured a $200,000 settlement for an 80-year-old man who developed severe, preventable pressure ulcers while recovering at a Virginia rehabilitation facility following orthopedic surgery. After undergoing surgery for a left elbow fracture, our client was admitted to a skilled nursing facility for post-operative care without any pressure ulcers and was assessed as being at high risk for skin breakdown due to limited mobility. Despite this known risk, the facility failed to provide adequate preventive care. As a result, our client developed severe wounds to his elbow and sacrum.
Despite having limited medical bills associated with his injuries, we were successful in obtaining a large settlement after arguing that our client had significant pain and suffering.
This case demonstrates that nursing homes and rehabilitation facilities must be held accountable when they fail to implement proven pressure ulcer prevention protocols, and it highlights the importance of families remaining vigilant for warning signs of nursing home neglect, including unexplained wounds and lack of repositioning.
